General Liability Waiver And Release Agreement


THIS IS AN IMPORTANT LEGAL DOCUMENT WHICH LIMITS YOUR LEGAL RECOURSE AND LIMITS LIABILITY, DO NOT SIGN IT WITHOUT READING IT IN ITS ENTIRETY.

IN CONSIDERATION of being permitted to participate and/or attend in any capacity an Activity (defined below) hosted by American Aerobics Association International (“AAAI”) and International Sports Medicine Association (“ISMA”) (collectively the “Organizer”), each of the undersigned on behalf of him/herself, personal representatives, agents, assigns, heirs and next of kin (collectively the “Participant”), intending to be legally bound, agrees as follows:

  1. Participant acknowledges and agrees that this Liability Waiver and Release Agreement (the “Agreement”) applies to their participation in any activity, program, or event planned, organized, managed, conducted, supported, guided, or sponsored by Organizer (the “Activity”), whether it be in person or virtual and the Participant’s use of the event space, classroom, college, public space, or other location.
  2. Acknowledgement: Participant acknowledges and understand that the Activity has inherent risks, hazards, and dangers that cannot be eliminated, including the risk of: SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (the “Risks”). These Risks and dangers may be caused by Participant’s own actions, or inactions, the actions or inactions of others participating in the Activity(ies), the rules of the Activity(ies), the condition and lay out of the premises and equipment, or THE NEGLIGENCE OF THE RELEASED PARTIES NAMED BELOW. Furthermore, there may be OTHER RISKS NOT KNOWN TO ME or that are not readily foreseeable at this time inclusive but not limited to THE SOCIAL AND ECONOMIC LOSSES AND/OR DAMAGES THAT COULD RESULT FROM THOSE RISKS COULD BE SEVERE AND COULD PERMANTELY CHANGE THE PARTICIPANTS FUTURE.
  3. Assumption of Risk: Participant HEREBY KNOWINGLY, AND FREELY ACCEPTS AND ASSUMES ALL SUCH RISKS, DANGERS, AND HAZARDS KNOW AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSSES, COSTS, AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS, OR RESPONSIBILITY FOR THE LOSSES, COSTS, AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE RELEASED PARTIES NAMED BELOW.
  4. Release of Claims: I HEREBY WAIVE, RELEASE, INDEMNIFY, COVENANT NOT TO SUE, AND FOREVER DISCHARGE AAAI/ISMA, its affiliated clubs, their respective administrators, members, officers, directors, representatives, agents, coaches and other employees of the organization, other participants, sponsoring agencies, sponsors, advertisers and owners and leasers of the premises used to conduct the event, or event inspectors, surveyors, underwriters, consultants, and other persons or entities who give recommendations, directions or instruction or engage in risk evaluation or loss control activities regarding the premises or Activity(ies) and each of them, their officers, directors, agents, and employees, (collectively the “Released Parties”) FROM ALL LIABILITY TO the undersigned, his or her representatives, agents, assigns, heirs and the next kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF ANY INJURY, including but not limited to death or damage to property CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE TO THE FULLEST EXTENT PERMISSIBLE UNDER LAW.
  5. Indemnity Agreement: PARTICIPANT HEREBY AGREES TO INDEMNIFY, SAVE AND HOLD HARMLESS the Released Parties from any loss, liability, damage or cost they may incur due to the participation of the undersigned Participant in the Activity(ies), or in any way competing, officiating, observing or working for or for any purpose participating in the event, and whether caused by the negligence of the Released Parties or otherwise; and EACH OF THE UNDERSIGNED PARTICIPANTS further expressly agrees that the foregoing Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement extends to all acts of negligence by the Releasees, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the State of Pennsylvania County of Fayette, and that if any portion thereof is held invalid, it is agreed that the balance, not withstanding, claims arising under federal or state laws, shall continue in full legal force and effect.
  6. Image/Media Release: I understand that the Organizer may have photographs and recordings taken of people present at the Activity. Participant hereby: a) irrevocably grant permission to the Organizer to make photographs, films, videos, reproductions, transcriptions and recordings (collectively “Recordings”) and to use, display, publicly perform, distribute, transmit, broadcast, publish, duplicate and post, through any type of media and in any form, including through and on the internet and websites, Recordings, whether in whole or part, of Participant while present at the Activity, and b) waive any right to inspect or approve Recordings prior to or after their use, display, public performance, distribution, transmission, broadcast, publication, duplication or posting. I understand that neither I will not receive monetary compensation in exchange for use of Recordings as stated in this Agreement.
  7. Health Care and Emergencies: I affirm my understanding that, by allowing me to participate in or attend the Activity, the Organizer is not responsible for providing health care services or health care insurance for Participants. I certify that I will be responsible for the payment of any fees and charges that may be imposed by any doctor or medical facility for the provision of medical care for any injuries, illness or condition involving Participant during the Activity. I agree to indemnify and hold the Released Parties harmless from any claim that may be made by a doctor or medical facility for such fees and charges.
  8. Health and Safety Policy Guidelines: Both before and during the Activity, the Organizer may make decisions as necessary to comply with health and safety laws, orders, regulations, ordinances and guidance pertaining to epidemic or pandemic level communicable diseases. These public health concerns may result in a disruption, alteration, or other modification to the Activity schedule including, but not limited to, capacity restrictions, re-scheduling, shortening and re-locating of activities, social distancing requirements and changes to format of Activity presentations and events. The Activity is subject to change as deemed necessary by the Organizer to address public health concerns. I understand the risks associated with potential exposure to contagious infections and diseases, and I release the Released Parties from any and all claims related to the potential or actual exposure to contagious infections and diseases related to or arising from my participation in the Activity. EVEN IF ARISING FROM THE NEGLIGENCE, ACTS OR OMISSIONS OF THE RELEASED PARTIES.
  9. Laws of the State of Pennsylvania: I understand that this Agreement is governed by the laws of the State of Pennsylvania. In the event of any action or proceeding the undersigned voluntarily submits to the exclusive jurisdiction of the State of Pennsylvania, County of Fayette.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE, ORAL OR WRITTEN, BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW, IN ADDITION, I UNDERSTAND AND AGREE TO FAIRNESS OF AAAI/ISMA CREDIT POLICY.
